Lindsay Lohan won't accept a plea deal in her case, sources say.LOS ANGELES - Lindsay Lohan will fight her necklace case to avoid a cameo in jail.
The "Mean Girls" star is due in court Thursday morning and will not cop a plea to avoid a trial on her single felony grand theft charge, sources told the Daily News.
Her lawyer met with the judge and prosecutor behind closed doors on Wednesday, but they reached an impasse.
TMZ.com reported the judge will give Lohan a continuance so she can rethink her decision.�
Judge Keith Schwartz had the power to sweeten the deal, but he made it clear at Lohan's last court date that any plea would involve time behind bars. If she doesn't plead Thursday, he said he'd send the case to a trial judge.
Prosecutors originally offered six months in jail and three months felony probation if the twelve-stepping starlet took the rap for allegedly stealing a $2,500 diamond necklace in January, sources told the News.
Her next stop is a preliminary hearing.
Ironically, if the judge handling that hearing finds there's enough evidence to put Lohan before a jury, that new judge could very well lock her up immediately for violating her DUI probation.
Lohan, 24, has already pleaded not guilty. She claims jeweler Kamofie & Company knowingly let her borrow the sparkling strand.
"They clearly loaned her the necklace," a Lohan family source said. "The surveillance tapes show so many inconsistencies in the [store owner's] story."
